Deck 3: Evidence and Investigation
1
Why does an investigator need to understand the relationship between investigation and evidence law?
An efficient investigator uses a fundamental knowledge of the rules of evidence to evaluate the usefulness and admissibility of the evidence as it is gathered. Knowledge of the rules also guides the investigator to the most valuable evidence, thus saving time and money.
2
What are the purposes of taking a statement and why should a paralegal review a statement immediately after it has been taken?
The purpose of taking a statement is to preserve information of potential witnesses and get leads from those witnesses. After the interview, review the interview notes and check the witness's statement for inaccuracies, typos, and leads that should be followed immediately. Make note of the leads and enter them on your deadline calendar. Unpursued leads can be damaging to the case and embarrassing to the paralegal and the firm.
3
The following is a list of possible evidence in Case I, the Forrester case. Based on your understanding of the necessary elements in a negligence case from Chapter 2, the information in this chapter, and the rules of evidence for both the federal (F) and your state courts (S), indicate whether the listed items of evidence are admissible (A) or inadmissible (I). State any applicable reason and rule number.
See completed evidence table. Please provide answers for your state rules.
