Todd wanted to have a child but did not want to get married. Straub agreed to have intercourse with her after she signed an agreement stating that she would hold him harmless for emotional and financial support of a child that might result from their relationship. Eleven months later, Todd gave birth to B.M.T. After three years of raising B.M.T. without any support from Straub, Todd filed suit for B.M.T. seeking a declaration of paternity and child support.
