The domain name aol.org was registered by Korea DNS, a South Korean entity, on September 3, 2001, and subsequently transferred first to an individual, Sujin Jeon, and thereafter to an individual listed simply as "Will E." Here in the United States, the domain name AOL.COM is registered to its parent company and owner, Time Warner\AOL. That name has been held since 1996. On July 30, 2002, America Online, the original holder of registered United States trademarks for AOL and AOL.COM, filed suit against the Korean company and individuals for infringement and violation of the Anticybersquatting Act. The Korean defendants filed a motion to dismiss on the grounds that the federal district court in Virginia, where AOL had filed suit and where its company headquarters are situated, did not have in personam jurisdiction over aol. org because it had no presence in the United States.
