Marianna Mays was a passenger in car that was rear-ended by a car driven by Samira Vejo. She sued, alleging neck injury as a result of the accident. At trial, the judge instructed the jury that if it were to decide that Mays was entitled to economic damages it must also award noneconomic damages. The jury awarded her $3,103 in economic damages and $1 in noneconomic damages. Mays alleged that an award of $1 was nominal damages or really no damages, and therefore the verdict did not comply with the judge's instruction. Had she been awarded any noneconomic damages?
