The containers arrived at Mobile, Alabama, and were put in the container yard at the Alabama State Docks A hurricane caused flooding of the container yard. In the ensuing lawsuit, Star claimed the hurricane was an "act of God" and that it should not be liable The container yard had never been flooded in a hurricane before, and prior to the flooding, the hurricane's path had changed numerous times.
