A pregnant employee at a retail store was operating a buffing machine when propane gas that powered the machine led to a carbon monoxide buildup, causing the worker and others to be taken to a hospital. The worker's fetus sustained oxygen deprivation, resulting in injuries including abnormal motor functions, cerebral palsy, and a seizure disorder. The worker sued on negligence grounds for her child's injuries. The employer defended by arguing that workers' compensation provides the exclusive remedy in such situations.
